C., the president of the belgian regulator (gaming commission) has declared in a belgian paper magazine that loyalty programs are legal in Belgium in the limits of 400 euros by period of 2 months for each player. A journalist has interviewed the president of the belgian regulator via questions send by email. She answered by email, so there is no error of transcription. The questions and the answers are published in dutch in the belgian weekly TV magazine Humo number 4360, 26/03/2024, page 135 (See last paragraph) (Photo van Wout van Aert on the cover). (I have the magazine, I don't reproduce it for copyrigt reason) A question was about the loyalty program offered by one of the biggest belgian regulated online casino and sport betting websites.(c****s.be I don't reproduce the name to avoid free publicity) The journalist explains that players can earn coins to buy gifts. The president of the belgian regulator answered that it is legal in the limits of 400 euros by period of 2 months for each player. I think amounts of 400 euros can be accumulated.(Ex : Earn coins but buy nothing for January, February, March, April and May gives the right to buy a gift of 1200 euros in June (1200 euros = 3 x 400 euros for 3 X 2 = 6 months) I think that prizes from promotions based on the skill like poker leaderboards based on results or betting leaderboards based on the quality of the predictions are not concerned by the limit of 400 euros since skill based leaderboards are a competition like a football championship and not a automatic gift. I know the site c****s.be . Like several other belgian regulated online casino and sport betting websites, c****s.be has a loyalty program which offers the possibily to buy gifts and vouchers with the coins earned. The loyalty programs are mentionned on the home pages of the websites. They are not "under the cover" and are well known by the regulator. All these regulated websites have removed their bonus deposit but have maintained their loyalty program and promotions like leaderboards, drops and others. Sometimes the player have to optin and pay little fees. In Belgium, the law is the same for online casino, online sport betting and online poker game. So it is clear that belgians players can participate in the promotions offered by the regulated operators of online poker game. Unibet online casino makes promotions for belgian gamblers.(Loyalty program, daily missions, leaderboards, ...) Unibet sport betting makes promotions for belgian bettors.(Free contests, free bets, odd boosts, leaderboards, ...) Unibet poker can reopen promotions for belgian players.(Loyalty program, missions, freerolls, leaderboards, ...) Unibet has mentionned in a previous thread that they received a message about promotions from the belgian regulator. It is clear that this message was about bonus deposit for new customers and did not concern the loyalty program itself since loyalty programs are legal following the well informed president of the belgian regulator. The previous thread seems indicate that the position of Unibet poker will not change without positive communication of the belgian regulator. The declaration of the president of the belgian regulator in the magazine is a positive public communication. So, the lights are green to loyaltyprogram and promotions for belgians players. If Unibet poker receives another message from the regulator about poker promotions (send by a not well informed employee), Unibet can answer that promotions are made according the declaration of the president and join a copy of the magazine legaly bought and translated by Unibet Belgium.

I thought that the €100 UOS Main Event Tickets were to register in a special event outside the schedule but it seems that it is not the case. In my mind, there is only one Main Event in a festival. In this "festival", there are a PLO Main Event and a PKO Main Event but no "Traditional Tournament" Main Event. Surprising !

Since a decision of 20th february 2020 of the Council of State of Belgium about the difference of treatement by the law between physical and online operators, the regulator asked the online operators to remove some promotions for 1st march 2020. All the operators removed free bonuses deposit. Some operators removed some other offers. Some operators maintained some other promotions. Some promotions reappeared or were created. So it is clear that the big problem was the free bonuses deposit.
  5. When a compagny makes an illegal promotion, the regulator contacts the compagny and asks to remove the promotion. When a compagny makes an allowed promotion, the regulator does not contact the compagny to confirm that the promotion is allowed. The regulator does not have a list of allowed promotions but only a list of forbidden ones. So, the job of the regulator is well to tell what is forbidden by the law and not what is allowed. It is not a "fictio" in a "parallel universe". It is the reality in Belgium : eveything is allowed excepting what is clearly forbidden by the belgian law. In Belgium, the law about promotion is the same for gambling, betting and poker. Making allowed promotions is the job of marketing teams and lawers. The orignaI post shows that the lawers of Unibet think that loyalty is allowed for the casino (like the lawers of other compagnies working under the control of the belgian regulator). The conclusion should be the same for poker. I repeat that the problem was the free bonus deposit offer. Without free bonus deposit, a lot promotions are allowed in Belgium. Sometimes promotions are free, sometimes the player have to pay little opt-in fees (0.01 €) to participate. Diminution of the fees via rake back is not forbidden by the law, so it is allowed.

The job of the regulator is to tell what is forbidden by the law and not what is allowed. The guidelines are clear : everything is allowed excepting what is clearly forbidden by the belgian law.
  7. Rake back is a diminution of the fees and not a bonus deposit. So where is the problem ? Belgian National Lottery offers free tickets to the registred players. Rake backt should be allowed.
